My common law partner would like to travel to the USA with our son to visit my parents. My son is a CDN citizen and passport holder so no problem (he is 2 years old). She is a Mongolian passport holder and we are not married - have lived together for 6 years. We currently live in South Africa. She has no income or savings at all. She has valid VISA's for Canada, Mexico, South Africa and has had a valid temp resident VISA for Australia as well in the past, so with her extensive travel record she won't likely be deemed a risk of not leaving the country.
My parents are CDN snowbirds who live in Arizona for about 4 months of the year. As such they don't have a USA VISA and they don't get a I-94 in their passport.
My question is can and how can, any of us sponsor her for this trip? I have sponsored her for every VISA she has ever gotten, but unfortunately the US doesn't recognize common-law. My parents could/would easily sponsor her but they don't have the required VISA's or I-94 to do this.
I have talked to the call center in South Africa for VISA processing and they said to just file an application for her with documents we think is appropriate and see what happens. Is that really the best way to approach from the start?
