  • In Laws denied visa at Chennai

    Hi All,

My in-laws went for the interview on 1/18/06 and after being asked only 2 questions 1.Who is in the US? and 2; How many children do you have and where?
they were denied the visa under section 214(b) which basically means they were not able to show ties to India....the officer there did not even look at the documents they had with them...We are wondering what would be the best way to go about it now?? Should we get another appointment right away or

Since they are going to be in Hongkong in March where they will apply for Permanent Residence can we have them apply from Hongkong??

I must add that this is the first time they are planning to come to the US

    Appreciate your suggestions.

There is no point in applying again immediately, unless your situation changed from the first.

Visachief...thanks for the reply we wanted to try again as the officer did not even take a look at the supporting documents, my inlaws do own a home and have a lot of family to prove their ties.

Would that suffice to try again??

        Hi

Looks like this is a universal problem for all aged people. The Consulate I think is looking for family, social, economic, employment and financial ties the applicants have towards their home country. Moreover applicants i have heard mentioning they would like to visit for 6 months. For the consulate this duration is a no no!

This looks like the maximum period allowed for a first time visitor at the POE. Do not exhaust the entire availability until you step into the soils of the US .

        Not legal advice!

          Visa rejected at chennai

Same thing happened with my parents as well on jan 18th at chennai consulate. Only question she is interested is how many children and who is in US. My parents visited twice to US and went back before 4 months of their visit. The officer did not look for any docs and just rejected the visa under 214.

We are planning to reapply, however, we are not sure if the officer would atleast look for doc this time atleast.

            My Mom was rejected thrice

My case is same. My mom has been rejected thrice. I do not know how we can convince the officer when they dont question us or look at our papers. How can my mom change her ties when I am her only daughter?

If they dont provide the reason then how can we guess the reason for ourselves when some things cannot be changed like for ex only daughter issue and re try again with out any hope of getting when we have been rejected thrice.

            Please can any body advise

            Pra

              Jan 18th Chennai

My parents also rejected second time..

1> Why are you planning to visit? Sons family and visiting.
2> How many kids you have? 1.

214B. I hate the lady, she is not even looking into the documents.
I hope some time this stupid process ends.

              We will try again.

Wrong day and wrong counter, wait for another 3-4 months, waste of another $400.

On top of it Pain in doing all these stuff.

              Good luck for others.

Also, do you think the questions asked were same in all the interviews...

My parents visa got rejected twice also. The second time, the consular officer (Lady) asked only one question, You have two daugthers in US? My parents said yes. She rejected based on 214(b).

My two cents... US visitor visa is a luck and has a messed up system that makes no sense. For your information I got a reply from consulate saying my parents did not provide documents showing their ties to India. This one thing proves to me that system does not work. Consular officer never saw any documents of my parents both times. My parents took all the documents and they do have very strong ties to India.

                      Hi Vij,
Yeah same here. That lady rejected. However, i am not sure what made her ask "U have 2 daughters/children in US" . The 2 times my parents were given 1 yr visa. This is the third time and they rejected for the first time. However, i want to retry. I hope they see the docs atleast this time.

Eventhough you think you have the same situation, CO has a various levels of determining procedure each time you apply.

                          Very sad

Is it the lady in Burkha that is rejecting all the people. I read in the forums earlier too that she rejected a lot. It is so sad. I dont understand why they reject without looking at any documents and just asking one or 2 questions. It is not fair at all. How can they judge if a person is a potential immigrant by asking a couple of questions. Looks like they are doing this for money.

There is no doubt in that, some CO's are crazy,

It is all your time and luck.

                            Keep trying.

Donno at times I feel that getting the visa is just a matter of luck! Some people with teh same background get the visa and some don't.
