Hello Friends,
My name is Luke. I am a green card holder, living in US for past 20 years. Getting married in a couple of months to a Foreign citizen in South East Asia. Please kindly advice me on questions below:
1. Thinking of getting her a Tourist Visa so we can have a honeymoon in USA. I will sponsor her from USA after our marriage and show to US Embassy's consular the letter of sponsorship, company where I work for, marriage certificate. She has been rejected once 5 months ago( prior our marriage) due to lack of strong tie connection to the Home country according to the consular. She is working as Financial Analyst. Would it make a difference once we get married to the decision of Tourist Visa?
2. Eventually I would like to sponsor her to get GC mid of next year. Once I sponsor for her green card, what is going to happen with her Tourist Visa? She is not going to overstay in US. Can she change her Tourist Visa into F-1 ( Student Visa) on the second trip next year? What would be the implication and effect to the Green card sponsorship that takes place prior the conversion of Visa? Does it present to INS as Visa Fraud?
Please kindly assist me. We direly need your advice.
