  • Revisit

    Hello,
I would like my mother to revisit me in May 2006.
    She made her 1st visit for 6 months--May2005-endof Oct2005.
    She has a 1yr visa valid till mid-March 2006.

If she goes for interview in late Mar 2006--1 week after her 1yr visa expires

    a) Would it be SAFE? in terms of VISA officier questioning her intent to revisit.
    b) Should she wait more (if yes till when) before applying for a new visa.
    c) Reason for visit: Tour USA with children?
Is there a way to convince VISA officier of this because revisit is happening in 1 years time after 6 months of intial visit?

    Other relevant points:
    Recent widow: Jan 2005
    Both children in US

Thanks as always to IMMI for help!!!

    it depends upon luck

it all depends upon luck. I am not trying to discourage you in my message but then people who go back to interview within 1 year of their visit to the US are almost always rejected. This happened to my parents even though they have substantial investments in India, file their tax returns, had a trip to the US and left within the period of 6 months. Their visa was rejected twice in the space of 1 year after their visit to the US. All my brothers and sisters are present in the US and my parents were honest about it. The time the US consular officer comes to know that all children are in the US they give a 214B reason for rejection mentioning that they might not come back even if they show that they came back to India last time. It always ended with the question of "how many children and where are they" There is no way to convince the officer that the intentions of coming back are true.

Yes. I guess it is same for my case as well. My parents were here twice towards end of 2003, 2004. Their visa expired in july 2005. They went for a visa appt in jan 2006, and were rejected since all children are here. (same questions asked). I am not sure for how long we need to wait for the next interview.

Hi PSI: Were your parents asked same questions the two times they went for an interview?

          same question

the first time the officer did not even bother seeing the papers and the interview was for 5 mins. parents went for an interview 6 months after their initial visit. The last question asked was how many children and where they are . They answered truthfully that the children are in the US and it was rejected immediately with a 214B.
The second time the interview took place for about 1/2 hour where all the documents were scrutinzed and a lot of questions were asked and the interview ended with how many children and where they are ? The situation had not changed as I am a GC holder and my sibling is a student . There was a rejection with a 214B. Second interview was about 6 months after the first interview.
Total time elapsed after first visit is about 1 year and 3 months , 2 interviews during that period of time has resulted in rejections both with same clause 214B.
Sometimes speaking the truth during these interviews just does not make any sense as it causes more stress and more work.
If all siblings are present in the US just make sure that the consular office does not know about it or make sure that you show some sort of documentation that some of the siblings are in India and they are yet to be married. This most of the time always gets you thru.
The safe period to apply for an interview after the first visit is about 1 1/2 years as that is what happened with my friends parents and the second time his parents were granted a 10 year ME visa.

            Hi!

Need not be the case everytime. I know two cases where they have all their kids here and have managed to get a 10 M entry visa. I really have no clue on what basics some similar cases are rejected and some are approved.
