    Dear friends:

    Can you please clarify a question for me.

    My parents have a 10 year visa and are visiting US currently. If they were to go back in a month after 3 months stay and want to come back again using their visa do they

    HAVE TO WAIT FOR 6 months elapsing after their departure date from US to re-enter again.

    I know some cases where people come back within 6 months and some say it is not legal. I am confused on this issue.

    Can anyone please help me with the rules regarding the gap between two visits.

    Hi!

    I don't think there is any such rule. However if they stay here more than in their home country then the INS might be a little strict as it would not look like a visitor.

      You can re enter as long as a you have a valid visa. Each time your stay is determined at POE. However, if you re enter with very little gap, you may have difficulty in getting visa once your visa expires, and you reapply.
