The misdemeanor cases are from about 4 years ago, one is disorderly conduct, the other one simple assault. I want to go to the states, so i will be applying for a B2 visa, im wondering what are my chances to get one? In regard to the cases, i was arrested and charged but never convicted, i was supposed to show up in court but couldnt because i had to go back home and since then that has remained open.
I know I can hire an attorney to work on those cases even if Im not there, but that doesnt guarantee a favorable outcome like having the charges dropped, or a B2 visa once the cases get solved.
As of now, at least I havent being officially charged, I believe if i can make it to court both cases will be dismissed as im pretty sure the accusers wont show up.
My doubt is, if I hire a criminal lawyer to work on the cases I will have to pay him/her and thats not guarantee i get the visa, i dont even know if that somehow increases my changes at all of getting it. If i apply to the visa directly and i get it, then i can pay to the lawyer, it kind of makes more sense and would save me money, or do my chances decrease because the cases are open?
Also, most lawyers cant guarantee outcomes, i could pay the lawyer and then he/she could insist in me taking a plea deal, which i do not want, or me having to show up in court with leaves me back in square one, except with less money. Any opinions/experiences greatly appreciated.
