So my fiance is in US he has h1 visa(I-140 approved) and I live in India and I have b2 travel visa ,we want to marry.But there are many issues kindly answer the below questions for the same.we have 3 options:-
-He comes to India ,we marry and I apply for H4 and I join him in US.But he cannot travel to India because he is on consulting job and does not want stamping issue while going back from India.so we cant do that.
-I go to US and and we get married there and apply for AOS (adjustment of status), from B2 to H4.But i heard then it leads to huge scrutiny while H4 stamping and it can get rejected too, as B2 is not meant for permanent immigration.Do you have any experience with the same?
-I go to US and and we get married in US itself and I take the marriage certificate from US and go back to my home country and then apply for h4 from there and join him .But thenm does the 30/60/90 rule
applies on marrying to h1 holders ? I mean do we need to wait for 90 days ..when I will be there on my visit before we apply for AOS .I know the 30/60/90 does apply on marrying to US Citizens .
