  • B2 visa overstay

Hi, I would like to enquire about an overstay of my wife. We met online and she came over to the US on a B2 visa. We got married after four months of her arrival (She arrived in June 2014 and wed in October 2014). Two months later (Dec 2014), we found that we were having a baby and that it would be best to have the baby back in Ireland where she stays. So we saved up and she left in May of 2015. Her overstay was less than 180 days and her visa was voided at the airport. I'm in the US and our son is with me (I went to Ireland for the birth and brought him back with me). We want to start the I-130 but are worried about her overstay being an issue at the interview stage. What can she say to the officer to convince him that she did not intend on overstaying?

It's good that her overstayed is less than 180days otherwise she would come under 3yrs bar to enter US again.
    Truth.
Try to convince visa officer that if my intention was bad i would have stayed in USA until delivery.
This is not a legal advice. Use at your own risk.
