  • Parents visitor Visa - Name mismatch in my passport and parent passport

    Hi,

I am in USA and applying for visitor visa of my parents who are in India.

The name of my mother on her passport and on my passport is different.
My passport has Mother's name as - Medhavi
and My Mother's own passport has her name as - Medhavini

I want to sponsor their visit to US.
Now, proving that she my mother using just the names on our passports would be difficult with current scenario.

    It seems I have 2 options -
    1. Change the "Mother's name" on my passport -
I will need to do this in USA with Indian consulate/embassy, which takes around 6-8 weeks in Houston and requires 91$ and requires one of these 2 documents - My Birth Certificate/School leaving Certificate having her correct name.
I do not have school leaving certificate. And I just have a old yellowish xerox copy of my Birth certificate. I am not sure this will suffice.
None of my mark-sheets have my mother's name.
They do not show appointment slots unless I pay, so I am not sure how long is a wait for the appointment and then 6-8 weeks after that for passport processing and delivery. My parents can apply visitor visa only after that.
With this approach I am not sure whether availability of only a xerox copy of birth certificate would be acceptable or not.

    2. Other option is my mother adds "other name" while filling up DS160 and during interview provides the "One and the same person affidavit" containing both the names mentioned above.
She has a old election card with Medhavi and passport with name Medhavini.
I hope no other supporting document would be required to get the affidavit as above two documents should be ok just to get the affidavit.
Now, I am not sure whether the affidavit would be enough during visa interview to prove that she is my mother and not sure whether it would cause any issues with approval of her visitor Visa.

Please help me with pros/cons of both approaches and any possible issues with each one to choose the best option.
Please help in case there is any other option as well.

    Thanks in advance!

It should not be a big problem. You can make one and the same person affidavit.

    Link for sample affidavit,
This is not a legal advice. Use at your own risk.

      Thank you for the reply.

Do you think the chances of approval are any less in case of the "One and the same person" affidavit?

This is not a major concern, you could submit an Affidavit of Support (AOS) while applying for their visit visa application, that both these names belong to one person & can still proceed with the application filing without any problem.

        I wish you good luck.

          Thank you for the reply!

          1.
There is extension of this problem with my Parent's application -
The name of my Mother on my father's passport is Medhavi while on her own passport it is Medhavini.

Will the "Affidavit of Support (AOS)" or the "One and the same person" affidavit still work in this case?

          2.
Do they need to have marriage certificate?
          Currently they don't have one.
Will the name issues mentioned above create a necessity of Marriage Certificate?
Do I have any alternatives to Marriage certificate?
Sorry for too many questions, it seems really tough doing this sitting in US instead of India.

I guess visa interview is already done by now, but for the help of others, carry proof that both the name belongs to the same person & you should be good to go.

As I mentioned, get proof that both names belong to same person & you should be good.

Also, do not forget to put second name in DS160 as well
