Apply for Parents Visitor Visa when h1B extension is in process

Hi Folks

My current H1B is expired and I94 also expired extension was filed on October 2015 on Normal processing.

Do I need approved I-797 copy when applying for Visitor visa? self sponsoring the visa is not possible for me as my parents do not have any business of heavy Income tax returns to show for financial guarantee.

Please advise.

As long as you have valid visa there should not be any issue. if you have copy of approved I-797 your parents can bring with them at the time of interview and show it if visa officer ask for the same.

I think that is a problem for me.

My h1 Visa expired and I94 also expired. My extension is in process(applied through normal processing).

Seems i need to wait until I get the approvedpetition.
