    hi,

    My family was rejected B2 visa under 214(b) as my husband forgot to metion that he was rejected H1 visa 10 years back. My brother in law is a US citizen,so i would like to know if he can send us an I134 form to convince the officer that we will be back before the expiration date. Also we have a well to do buisness in india and i have a rental income aswel,so in the DS 160 form should we state that we would be sponsoring our trip or my brother in laws sponsoring. And also he would be sending a letter to the consulate and an invitation letter to us.please tell me if I 134 is required if we sponsor our trip because the form would guarantee our return.

    I-134 form is for affidavit of support. That form is requires only if your brother in laws sponsor for your trip.

      I-134 cannot be legally enforced. That form has no force in most cases. It is good to take it as a backup but visa officers seldom will ask for it. Your chances of receiving the B2 visa are best if you can show a strong financial background of your own. The picture you present should be such that the visa officer is convinced that (a) you can easily defray all the expenses of your visit to the USA and (b) paying for your trip will not place any stress on your financial health. If these conditions are not met, your second best option is to have your relatives in the US pay for your visit. The person will have to send you a letter stating he or she will pay your costs (here the I-134 is good to have but the VO may not even want to see it). Your relative should also provide you a letter from his or her company stating employment and salary. You should also know of his or her immigration status - whether citizen of USA/green card/visa status.

        I134 just shows a reason for your visit to USA & financial support. However to get the B2 visa you'll need to show strong ties in your home country, which tells VO that you'll return back.

        Your BIL can sponsor your parents (i.e. his in-laws) but its seldom acceptable for other relatives.

        You need to show a good enough "white" income to convince VO that you can spend few lakhs for this visit.
