  • visa denied help!

    My husband was recently denied the tourist visa. I am an American and so are our 2 children. We live here in Mexico and my husband has a job that's he's had since 1997 (he works for the govt), a car and motorcycle in his name, is enrolled in online classes, has a bank acct, and a daughter from his ex wife and family all live here in Mexico.
    His interview lasted approx 5 mins, the officer didn't ask for any paperwork, after a couple of questions he said my husband didn't qualify and needed to apply for a immigrant visa. My husband explained to the officer that he doesn't want to move there, we are only going for 9 days (what his work allows) to visit my parents and he even has his plane ticket (roundtrip) but the officer didn't listen and just kept repeating that he needed to apply for the immigration visa. He cannot apply for the immigration visa because I live here in Mexico.
    What are his chances to get approved if he reapplies for the tourist visa in a month or so?
    Please help! Ray B any advice?

    Each U.S. consulate post seems to have its own attitude about visitor visas. Frankly, though, I am surprised at your experience, which is quite common for Philippines (80-90% denial rate for visitor visas there).

      Are his chances better or worse if he reapplies? Ray B or anyone else!
      Does it help if he writes a cover letter stating all of the reasons he has to come back to Mexico?

        Tourist visa is typically denied for potentially immigrants. Since you are an citizen & married to him, he is very well treated as potential immigrant. I do understand that he does not want to stay there permanently, but I would suggest to sponsor him a Green Card. it will be easier & a sure success story.

          Why should someone need to buy a new car when all that is needed is a short rental?

          Plus, he cannot be sponsored as his USC wife lives in Mexico. Apparently there seem to be plenty of ties to home.. as mentioned by the OP.

            Thank you! Any other advice would be of great help! Like when does he give them the letter? When he gives them his passport? They don't ask for paperwork.

                Hi,

                Instead of applying for a Tourist visa, for better chances you can apply for a visit visa if you have anyone who can help you with the Invitation letter a formal email stating the purpose of inviting, duration of stay in that particular and the Status of the person who is inviting you. If you help with all above details I’m sure you will have success in visa.
