  • Refused B2 Visa for In Law, need advice from seniors

    Hi All,

I have been following Immihelp since last 3 months. All the information posted here and the threads are very much useful. Thanks a lot for making this data available for all the needy and confused people like me.

I am an H1 Visa Holder and my wife is on H4. My Father applied for a tourist Visa in March 2016 on self financing and he got the Visa.

My Sister in Law (Age 30) and her Husband (Age 31) went to an interview for B2 visa today (tourism purpose) and they got rejected with reason of "No strong Ties to India". I understand this aspect of US consulate is to prevent people illegally settling down in the US. However, some of the genuine cases, like ours, get affected due to this.

I declared sponsorship for both of them as their combined monthly income in India is under Rs. 40,000 per month. They neither have any properties on their name nor have any big investments to show.

We applied through a visa agent.

Here are the interview questions: (Interview was in Hindi)

    1. Where do you work ? (To the husband)
Ans: I work in so-n-so company and my duties are so-n-so.

    2. Where do you work ? (To my SIL)
Ans: I work in so-n-so company and my duties are so-n-so.

    3. Have you ever been to any other countries ? (To the husband)
    Ans: NO sir.

VO: I am sorry but you are not eligible for the tourist visa at this time.

The elder brother to the husband of my SIL is also in US on H1 visa with his family.

I understand, having a higher income, self financing the trip and visit to other countries in the past would make the case stronger. But if we do not have these, are we not eligible to visit US ?

I myself is a H1 visa holder (not a Green card holder or US Citizen). We are anyways not going to stay in US beyond my Visa validity. We need our SIL to be with us for 3-4 months to support my wife in her pregnancy. Her or my mother are not able to travel to the US for health issues.

Please suggest if it is worth trying again for the B2 visa for my sister in law in 3-4 days. This time we will apply for Sister in law alone and not with her husband. This will be the only thing which can show a "strong tie" to India. Already, other ties like, parents and parents in law alone in India, properties of parents did not get consider strong enough. Will this make any difference in our case ?

Need guidance from your experience please !

    Best Regards & Thanks.

For this reason, you are trying to eat-up one of the nanny/babysitter's job.

That's even risky after first rejection. I doubt it will be again rejected.
