Can we apply for ITIN?

Hi,

My husband is travelling to US on B1/B2 for office work. Actually he has H4 as well (H1B primary holder is me).

Can we apply ITIN for my husband as he is travelling on B1/B2? Please help me with this info.

Yes, you can apply for an ITIN for hubby, so long as the W-7 form is attached to your Federal income tax return and paper-filed to IRS at the special Texas ITIN processing address.

1. Yes, hubby can applyf or ITIN even if he has a B2 visa. That's what the ITIN is for, to be available to people not eligible for SSN.
2. He cannot apply at an IRS office for an ITIN.
3. To get an ITIN, he must submit form W-7 (ITIN application) with your income tax return, and paper submit tax return with W-7 to the ITIN IRS Texas address.

Cant we go to IRS office with my tax documents and W7 forms? Because my hubby is staying here only for 14days, sending documents to Texas and processing will take time as it includes his original passport details and all. Appreciate your response.

You can take your tax return and W7 form to an IRS office and they can "usually" authenticate the supporting proof of identity (copy of hubby's passport and marriage cert), but the IRS office will either forward the package to Texas as a hardcopu submittal, or give everything back to you to submit by postal mail to the Texas IRS office.
