    Hi,

    My parents have a renewed visitor visa (B1/B2). They had visited US in Mar 2015 and stayed thru Aug 2015 and again visited US in Oct 2015 thru Mar 2016 on the old visa prior to the expiry of that. They had not over stayed any time. If they are intending to visit US in Jun 2016 , will there be any issue if they are only going to stay for 4 months or are they violating any rule here.

    Generally it is suggested to stay out of USA for the same amount of time you stayed in USA. For example an 6 months stay in USA (Oct'15 to Mar'16) would need a 6 months stay outside USA (Apr'16 to Sept'16).

    If they attempt to visit in Jun'16 they may have to go through extra questioning or at worst may be deported or may have problem in extension or subsequent visits.

      They were in the US 12 out of 14 months?

      They could be viewed by the CBP as living in the US, an abuse of the B2 visa. Remember, visitor visas are primarily for short visits!! They're likely to face issues on their June visit.

        Thanks for posting your replies. I think my parents should have postponed their last visit and then this situation could have been avoided.

          Yes, now let them compensate it with waiting for some more time in their home country.
