  • Former green card holder. now need a tourist visa

I lived in the US for seven years and had a gc through marriage. Then we got separated and I returned to my home country and lost the gc. Now I want to visit the US to see my children. What should I do?

Is that GC still valid or expired? Do you have all your documents of divorce?

If the GC is expired, you should be good for applying B2 visa for yourself.

The GC expired because I remained outside of the US for more than two years. But the other problem is that my spouse and I have not yet filed for divorce even though we have been living separately for several years.

You abandoned your US residence, so the GC is no longer valid. More importantly, if you apply for a visa now, your past will likely be an issue. Be prepared to answer questions about why you left the US while married, and lack of divorce from a USC spouse.

Also, as noted in your post on another forum, you need to officially hand over your green card to the local US embassy.. in pakistan?

So, legally speaking you are still married & that makes you an "potential immigrant", most likely your B2 visa will be denied.

It will be better for you to get your divorce documents in hand. It will make your life easy in long run & will avoid any legal issues.
