    Hello!
    I am a spouse of a legal permanent resident in the USA on a B1 visa. My wife filed for me while I was in the USA in January 2016. I need to be back in the USA in September 2016 to attend job inteviews on the same B1 visa as I wont get an immigration visa so early. I want to know if I can be banned if I try to enter the country with an I 130 pending. I have heard of a few cases before where people were slapped with a 5 year ban. Has anyone tried to do this? Any experiences or views shared will be valuable.

    You cannot attend job interview on B1 visa (its illegal).

    You can enter in USA with pending I130, but make sure you can convince CBP that you have valid reason for the visit & you will definitely go back.

      You will visit on the date and you have file the petition I-130 means you are eligible to live in the U.S. Permanently upto the GC valid

        Thank you for your replies. I'm a medical graduate and I'm eligible to attend interviews for medical residency training. I'm presently in the USA but my i94 expires soon. I understand that I can't stay back and apply for adjustment of status until my priority date which will make me illegal. So I have to come back on B1 visa.

            This is so confusing.. spouse of an LPR on a B visa?

            Or an LPR since '05 with long overseas trips?
