  • expired greencard in 2012 and need to B2

    Hi, Can someone help..
My greencard has expired in 2012 and now I need to go to US with husband and kids for vacation. They are all US citizens. I dont wish to apply for a new greencard since I dont intend to live in USA and cannot maintain residency at this time as I'm living with my husband and kids outside USA due to husband work situation. can I apply for B2 visa without going through I407 application "surrendering greencard" if not, what are my options? if I have to go thru i407, does it take long?
    Thanks

Once you apply I-407, you surrender your status as lawful permanent resident and you will never be able to apply greencard again. You would not like to do it. In your case, you would have 2 options. Option 1 is to file I-90 (electronic filing) to renew your greencard which could be done if your greencard has not 10 years expired. This case will take about 3 months, I guess. Option 2 is to get visit visa but also make sure to file I-90 to make your greencard alive.
I think Option 2 would be faster and the best.

This is my opinion not legal advice. I just want to help you to thoroughly consider among doable ways but you take your own risks.

I'm in the similar situation as Hana but would like to surrender LPR (Green card)

I would like to apply for B2 visa and surrender greencard using i407 application. Please let me know if someone has gone this experience recently. I live in Bangalore, can Chennai consulate accept the i407 application while applying for B2 Visa?
