  • Getting married in the US while on B2 visa

    Hi, my girlfriend and I are going to get married when she gets here (on a visitor visa) and (I, a US citizen) will file an I-130 and an I-485 for her shortly after we get married.
    She does however have a pre-planned vacation (about a month and a half after we get married) with her parents outside of the US.
    My question/concern is, will she be able to re-enter the US after her (2-week) vacation is over?

    That's preconceived intent, and therefore fits the definition under visa fraud. She cannot.. repeat cannot enter the US on a visitor visa with the intent to file I-485.

      Is it OK then if we only get married because to get married where she is from is a pretty convoluted process?

        Where is she from and why is it a convoluted process? And it's not a good idea to use a visitor visa to evade the existing immigration process.
