    Hi there,

    I am German citizen and was let go from my company last month while being on a L1-B visum and immediately filed I-539 to request a change of visa status to B2. The application has been received by the USCIS on May 16 and I am now awaiting approval. My issue is that I am leaving for a vacation to Colombia on Saturday (July 25) and I am not sure if I will receive the approval by then.

    My question now is if I can file for an ESTA visa since Germany participates in this agreement? My flight back to Germany is booked for July 31 and I plan to start my new job once I get back to Germany. If I present my current I-94 (which still has the L1-B visum and date to stay in the US until October 2017), my I-539 application for B2 and a copy of my ticket for my flight back to Germany on July 31, is it likely that I will be admitted back into the states once I return from Colombia? Or should I file for ESTA?

    I would suggest to file ESTA to be on safe side.
