  • Married 4 Years and have not applied for Green Card

Hello Everyone, I am new to this site and I am not sure if i am posting in the right Forum but my situation is this ,I met my US Citizen Husband on ******** in February 2010, He came to my country to meet me in person in September 2010... I then visited the US in December 2010 and stay for 3 weeks vacation. I retuned to my country for one month in January 2011 and I miss my husband so much i return to the US in February 2011 and stayed for 4 month. I then returned to my country in June 2011 and was back in the US again in July 2011. I never went back to my country. My Husband and I got married in August 2012 and I have not applied for any adjustment of status as yet because of my husband's tax situation. We are still in the process of trying to file his taxes which he has not filed since 2010. My question is , when I am ready to apply for my green card would i be penalize for taking so long to apply? we are still very much in love and we lived together from the time i came to this present date.

no i have been married 6 years and only just filed AOS so long as you entered the country legally you will have no problems ,you have been lucky to have left and come back without a problem ,remember once your taxes are done you have the cost of the filing , medical police report ( if you have ever been arrested ) photos ( get them at Costco cheapest any where ) so look at $1800 plus legal filing fees as i would not recommend filing on your own , look - up Christian Charities on the web or other legal help groups i paid $700 .
Best of luck and it really isnt as bad as you think

When filing for Adjustment of Status in the U.S., foreign or domestic police reports are not part of the submittal package, as USCIS will do a name check after Biometrics.
