  • Visitor visa denial under section 214(b)

    Hi,

We applied for self-sponsored visitor visa for my sister who is a working a physiotherapist in India. Both my parents are in the USA now on visitor visa and I mentioned the same in the DS-160.

We prepared the below supporting documents for my sister:

    a) Leave approval letter from Employer
    b) 6 months bank statement showing enough funds
    c) Invitation letter from me

Unfortunately the consulate officer did not ask for any documents. He asked the below questions:

    a) Why do you want to go to USA? Ans: To meet my sister and for tourism.
    b) Is your sister working? Ans: Yes. Where? Ans: Company xxx.
    c) Where is your sister located? Ans: Address yyy.
    d) Does your sister have a family? Ans: Yes she is married and stays with her husband.
    e) What do you do for a living? Ans: Working as a physiotherapist in hopsital zzz.

After these questions, he said "We are sorry, we are not able to issue a visa for you at this time". Also he gave a document in which the below option was selected "Dear Applicant, This is to inform you that you have been found ineligible for a nonimmigrant visa under Section 214(b) of the U.S. Immigration and Nationality Act. A denial under section 214(b) means that you did not meet the requirements of the classification of the nonimmigrant visa for which you applied".

We are wondering why the visa was rejected. Can you kindly provide your suggestions.

    Questions:
    a) Can we reapply for the visitor visa? How soon can we reapply?
    b) What could be the reason that the consulate officer found that my sisters application did not meet the requirements for the classification of the nonimmigrant visa (B2)?
    c) What should we change to increase the possibility of approval in case we reapply?

Appreciate your suggestions in this regard.

    Thanks in advance !!

    1. You can reapply at any time.
    2. Marital status. Single or married, not enough strong ties back to home country.
    3. Mostly you can't change anything on your side unless there is some major changes from her side.
