  • Duration of Stamping On Arrival

    I have a valid B1/B2 US visa, valid till Nov6, 2017.

    1. I am going to purchase an India - US - India round trip ticket.
    2. I will be staying with Friends in California, Pittsburgh, Arizona and in hotels if any travel plans transpire.
    3. I have cousins (family) in USA however, I am not sure I would be able to visit and stay with them due to their busy schedules. They are working as Radiologists and Paediatricians.
    4. I am unmarried also I do not have a job currently however, I have no intention to stay back in US as I have my aged parents (Senior Citizens) to look after in India.

Following are my queries before I plan to travel to US for leisure for 3-4 months.

    1. I would like to know whether after having valid Visa and return tickets for the said duration; will I be stamped at the US entry airport for the said duration (3-4 months)? Or could there be other objections to my trip at the port of arrival in California ?
    2. Could they stamp me for less number of days than my return ticket ?
    3. How long can I say in US with B1/B2 visa ?

Entry or denial, and length of stay are determined by CBP at poe.

You have an active B1/B2 visa until November of 2017. The dates are always up to the POE but the maximum time issued is 6 months. If your travel plans appear to be accurate and you will have your return flight information showing the dates you are wanting and they are less than the 6 months that could be issued, I would think you should not have any problems. However, the only person who can confirm that is the POE officer. But again, I do not see any issues based on what you have provided.

This is my opinion and not legal advice. Use of this information is strictly at your own risk.
