  • Visitor visa denial

I visited your web site about a month back and really appreciate the information you are providing to other immigrants.

My parent's non immigrant visitor visa application was rejected yesterday. It is sad that even though they produced substantial evidence to indicate their return back to India like property information, bank statements, pension papers, sponsorship doc etc, their request was denied.

I am a permanent resident and my brother is on L1A here (he just moved to US in Dec'05). The visa officer concluded baselessly that my parents have no reason to go back to India since both son and daughter are in US. All my parents wanted was to spend some time with us in US and then go back to their home base in India.

What is the procedure for re-application? Is there a way their application could be considered after a short time period (instead of waiting for months together for an appointment?). They were very eager to meet us in March / April 2006. They already planned and scheduled for this appointment way back in Nov.

What kind of additional documents should they have provided or provide in the future interview?

I am really upset by the visa's officer's attitude.

    Looking for your advice.

    don't worry

don't worry even my in-laws visa got rejected the first time in may 2005...we thought of taking the appointment again after about 6 months...they got the appointment for feb, 2006 ....and HURRAY this time they got a 10yr multiple entry visa.....

my father-in law is retired and mother in law is a house wife......

but then they have 3 children and out of them only my husband is in u.s ... both others r in india....

i wrote a letter to the conslate stating the reasons y they will come back....
(all that i could think off)......and they carried a photoalbum (a big one) of all their relatives....

luckly the consulate there just read the letter and looked at my husbands documents.....asked a few general questions and gave them the visa......

    BEST OF LUCK

Thank you for your replies. Very much appreciate your help.

Also, though my parents applied from Chennai initially, can they reapply in Delhi? They have a house in Delhi. Is it against the rules?

Changing of consulate is allowed only if they the applicant has solid proof of current residence of 6 months long in the new place jurisdiction area.

Thank you for the pointer. My parents have been living alternately in Delhi (their house) and Bangalore (my brother's house) for the last 4 years. They bought the Delhi house a while back (more than 11 years). Does that mean they can apply from Delhi even though their visa was rejected in Chennai? They have ration card, voter id etc. in Delhi.

Also, though I would like to wait for 6 months before reapplying, I am expecting a baby in May and would like my parents to be here.

            Looking forward to reply.

            Thanks
