  • Visiting the US on a B2 visa while married to a US Citizen

    Hi all,

I've read a lot of the posts in this forum, but is still confused.
I got married to a US citizen while on a J-1 visa that expires in mid-September. My husband got a job with an NGO in Central Africa and we traveled together to live there this week.
I've applied for a J-1 waiver before I leave, and just received an approval, and we're intending to apply for a green card for me eventually (Probably in 2017).
In the meantime, we have plans to visit his family for Christmas, and I have to apply for some kind of visa to go back to the US. Most convenient option being the B2. Would entering the US on a B2 (granted it gets approved) be a problem? I'm only intending to use this visa as a way of visiting family and friends till we decide what our next move is.
My husband's work is not temporary, and we're planning to stay here for a couple of years at least, and I can provide evidence of that.

    Please advise!

    Thank you

You can apply for visitor visa. But in ds-160 form you have to specify that your husband is USC and it will be very difficult for you to prove non immigrant intention.
