Parents Got Visa Rejected

Hi

My Parents Visa Got rejected on Nov23 2005.
The Questions asked were following

(1) Who are you visiting in US
daughter
(2) How many sons and daug. and what they do

2 dau in India, one son in India
and 1 dau in Belgium

(3) Where is Belgium

(4) Asked for my passprt copy
I did not have H1 stamp as never left USA in 3yrs
after getting H1 so officer told my dad that I am
working illegally in USA

My father showed Emp. Verifcation and did not
have a chance to show I-797 and visa got rejected
immidiately.

My Mom got visa.

When I read your post last week I was little worried about my moms interview. My case is also same as yours. I don't have H1B stamp in my passport and I sponsored my Mom. She got her visa today. I asked her to tell the officer than I am on H1 visa and working for so & so Co. She did mention that to the officer. Parents cannot bear when somebody says that their son/daughter is working illegally. I asked my mom to argue if they say something like that. Ask your parents to try again and they need to really talk for you and for themself. When there is a proof(I-797 and I-94) that your parents can show you are working legally, officer has to show to prove that you are working illegally. Visa's can be rejected saying that you are potential immigrant and no strong ties, for things which we cannot argue, but cannot say that you are working illegally.
