  • B2 for marriage and return to home country

Hi all, we need to decide soon on our next course of action. I am a US citizen living abroad in Vietnam, she is a Vietnamese citizen. We are getting married next year and all we want to do is visit the US. We fully intend to live in Vietnam for the next several years. We've tried twice, in 2014 and 2016, and were denied a B2 visa by the Ho Chi Minh City US Consulate after very short interviews. Our relationship seems to be the cause for the denials. After doing a little more research it DOES seem that a B2 visa is viable just as long as she returns to Vietnam after we are married in the US. Some 'legal advisers' also believe that a K-1 fiance visa is not advisable in this situation. I'm looking for anyone with first-hand experience or reliable info on being upfront about intent. During the last interview, nothing was asked about our actual plans. Upon hearing that she was the fiance of an American citizen, they denied the application after 3 questions and didn't look at anything that could support our intent. If she makes it a point to tell the interviewer that we plan to marry with a B2 and then return to Vietnam, do you think it will matter? Of course, she still has to show sufficient ties and intent to return, but would the interviewer actually look at these ties and evidence this time?

Also, my posts from earlier this year describe this in a bit more detail, but anyone with further info on whether or not a K-1 visa can be used for this situation please contact me.

She plans to marry on B2 visa and return back visa officer may not believe this and result might be visa denial.

If she comes here on K1 visa. You also needs to be in US and marry within 90 days of her arrival then you need to file adjustment of status for her. In your situation K1visa for her also might not work.

    More information on K1 visa,

She can try again B2 visa.
