HELP! RFE I-485 question. Anyone with similar experience got approved?

  • HELP! RFE I-485 question. Anyone with similar experience got approved?

    I submitted my application to be a permanent resident, and my husband's (US Citizen) my sponsor. We neglected to include evidence of his current income with the application, although his income exceeds the 125% poverty guideline. Received RFE requesting:

    -sponsor evidence of sufficient income, including paychecks from past 6 months
    -"Based on the documents submitted with Form I-864, Affidavit of Support, the income did not meet 125% of the poverty guidelines for the sponsor's household. Submit evidence of assets that meet the standards listed below or obtain a joint sponsor."

    I've read a few different forums and people have advised that as long as you submit evidence that he his current income is sufficient, the 2nd part should no longer be applicable. But what worries me is that the letter says failure to submit all requirements WILL (instead of may) result in a denial.

    Has anyone been in this situation, where you submitted only income evidence and got your application approved anyway? What action did you take and what was the outcome?

    Your Affidavit of Support and income proof did not satisfy the reviewer. Whether your next submittal, in response to the RFE, will satisfy the reviewer depends on how convincing your evidence will appear.
