    Hi all

    First post here and would appreciate any constructive assistance.

    My wife and I are Australian but wanted our child to have a US passport by being born there. She's currently nearing the end of her first trimester.

    We can enter the US under the visa waiver program which is valid for three months - but it's probably safer for her and the baby if they travel within the 7th month of the pregnancy. Given the time that's require to get a passport for the baby post birth, we believe that there is a chance that she'll overstay under the VWP, so we plan to apply for a B2 visa which is valid for 6 months.

    We have family in the US and can prove to immigration that we have the financial means to pay for all related expenses. We intend to return to our current country of residence (Singapore) after the child is born.

    I've read that it isn't illegal to travel to the US to give birth and that the CBP can turn a pregnant woman away if they feel that the child might end up being a ward of the state (i.e. we can't look after the baby after) - which isn't the case for us. I've also read that we should be upfront with the immigration officer when asked about our intentions.

    The question is really what do we tell the consultate when we apply for the visa and what do we tell the immigration officer? Will honesty end up causing more issues, especially with the current anti-immigration sentiment going around in the US...

    Anything else we should worry or watch out for?

    At the time of interview visa officer will ask reason for the visit and if she answer honestly most likely visa officer will deny her visa.

    In your case honesty will cause more issue but still you have to tell the truth and let visa officer decide.
