  • New B2 Visa for a Previous J1 Holder

    Hi all,

This is my first time on these forums, and I'm looking forward to hearing from you guys. I've done quite a bit of research, but cannot seem to find a situation that quite resembles mine.

I met my Chinese girlfriend while she was completing an exchange program in the US while on a J1 visa. She has since returned to China (and not out-staying her visa), but wants to visit me again and we wish to travel together in the US.

She will have worked for three months by the time she applies for the visa and her immediate family is also in China.

One issue is that she does not have a substantial amount of money saved up and I plan to sponsor this trip. This could raise some concerns in my opinion, as it seems to be a bad idea to mention any romantic relationships.

Here are some questions I have:

    1. Does this previous J1 visa help her in obtaining the B2 visa in tha she didn't become an illegal immigrant at her first opportunity? (I couldn't find this answer anywhere and I would think this is a pretty strong claim).
    2. Is it an issue that I am sponsoring this trip? Without mentioning that I'm her boyfriend, I feel its a bit odd that someone would sponsor a rather expensive trip such as this one. (I've seen mixed feedback on this one)
    3. Would it be a better case to have her cousin in NYC sponsor her for this trip? She doesn't plan to meet her cousin... but those arrangments could be made depending on how this visa situation plays out.
    4. Is it a problem to change itineraries after the visa is obtained? We could make the above arrangments and modify the trip later.

On a side note, when she returned to China from her J1 visa, she went through the electronic immigration booth in China and didn't get a stamp with the date she returned. Thus, her passport itself doesn't indicate she didn't outstay her welcome in the US during her J1. Getting the Chinese goverment to provide the electronic records is probably very complicated...

If item 1 is a strong enough claim, then I'm hoping the easiest way is just to say I'm sponsoring the trip, we'll leave out the boyfriend/girlfriend part, I'll prep all of the documents possibly needed, and we'll be on our way. I just have no clue how strong item 1 really is.

    Thanks all!
