  • Tourist visa for my girlfriend who lives overseas

    Hey folks I got a girlfriend who has immediate family(citizens) here in the US, can they invite her to visit on a tourist visa? Can I marry her when she gets over here and get her status adjusted? We've been together since 2013 and actually lived together for a while when I visited her overseas.

    Invitations aren't required for a tourist visa.
    She can marry you in the US while on a B2; she then exits the US while you petition her. She waits out the process and interviews in her home country.

    Entering the US with pre-conceived intent to adjust status is visa fraud and thus illegal.

    What country is she in? Single females from certain countries have a higher bar being approved for a visa.

      If she makes it in and did not lie, you guys can marry and she can do Adjustment of Status.

        Wouldn't advice entering the US with intent to Adjust Status.

          You would petition her for a K1 Fiance visa. Once approved, she would enter the U.S. and you would have 90 days to marry. Once married, you would then file for her adjustment of status. This is the appropriate path a U.S. citizen would take to bring someone to the U.S. they intend to marry.
