Having a baby while on a tourist visa

Hello,

I am currently pregnant and I've had a high risk pregnancy so far. I have an international insurance as well as the economic resources to seek for good medical care in the US. By that i mean a good hospital that provides a good NICU in case something goes wrong with the baby as well a good management of cases like mine. I do not trust my country's health services in that kind of situation. The thing is, i've had a visa all my life, i am a frequent traveler to us and other countries, i have a job here, a house i am currently married and have no intention of staying in the united states, but i am worried that if i have my baby there (and by that he gets to be a us citizen) i may have trouble renovating my visa. I know it is not illegal to have a baby in the us, specially if you pay for it, but i would like to have some counseling with this as i just want the best for both of us.

The purpose of a B1/B2 tourist visa is not to come here with the intent to have a baby. First of all, POE officers can turn away anyone who is pregnant and not let them enter the U.S. once they arrive. Second, when you are leaving to go back home with a newborn or infant, they can revoke your visa as you leave the country. Visitor visas are issued for a maximum of 6 months and if your leaving with a baby, you came in knowing you were pregnant and intended on staying here to give birth. People try to come here all the time and have their child here so the child will have U.S. citizenship. First, so that someday the child can return or also so that the parents can try and immigrate because of the child. I understand you may have a high risk pregnancy and your reason for wanting to come here, but it would not be viewed differently. Will they throw you in jail for having a baby here? No. Will you have to pay for everything out of pocket? Yes Is it expensive here to have a baby here? Extremely. Maybe you could look into alternative countries that could provide better care other than your own. You could always risk coming here like many others, but you most certainly could loose your visa in the process.

This is wrong. Medical care is one of the intended purposes of B2. And people do get B2 visa open declaring that they intend to use it to have a baby in the US. There is nothing wrong with that. Being pregnant and/or intending to have a baby in the US is not a valid reason to deny someone entry. Please be advised that the poster already has a B1/B2 visa that was issued for tourism. She did not originally apply for a B2 medical visa, disclosing her intent for treatment as well as meeting all of the other requirements necessary to obtain a medical treatment visa here in the U.S. paying for it or not. If someone does not have any health issues and just wants to come here to the U.S. and have their baby, their application would be denied. I can assure you, there is not a come to the U.S. and have your baby here so it can get U.S. citizenship visa.

That's why they have a separate medical visa that can be applied for if it would be actually necessary or warranted to come here for medical treatment. However, it has to be proven it is necessary by medical professionals and that the treatment can not be obtained in the home country. The poster not being comfortable with her countries healthcare system is not going to warrant her to come to the U.S. for delivery more than likely, and the fact that the poster mentions citizenship at all..... (and by that he gets to be a us citizen), probably shows their true reason for wanting to have the baby here. We can not be the only country in the world who can deliver a child and handle a high risk pregnancy.

If someone does not have any health issues and just wants to come here to the U.S. and have their baby, their application would be denied. I can assure you, there is not a come to the U.S. and have your baby here so it can get U.S. citizenship visa.

This is not correct. People can and do get visitor visa just for coming to the US to have their baby without other medical issues. There is no reason to deny it.

A friend of mine had a very similar situation. She had a B1/B2 visa and before she got pregnant she used to come to the US at least 2-3 times a year and never overstayed, so her immigration history was clean. That said, she decided to come to the states and have her baby because the baby would receive a better care. "when the immigration officer asked for her reason to come to the U.S. she said: Visiting (which was true because she has family here)" Is it really true? This is how someone who wants to feel ok about being dishonest will present things. America is not the only country who can deliver a healthy child. What she really wanted was U.S. citizenship for her child. That is what truth looks like.

I am curious about the "International Insurance and economic resources" you are referring to. To my knowledge, there is not an International insurance that will cover pregnancy. But, if you have found the 1 that will... I would love to know what company it is.

What she really wanted was U.S. citizenship for her child. That is what truth looks like.

And it is perfectly allowed to go to the US on a B2 visa for the purpose of having a baby so that the baby will have US citizenship. There are many people who honestly tell the truth to the visa officer to get a B2 visa and immigration officer at entry, that they want to visit the US to have a baby so that the baby will have US citizenship, along with how they will pay for it and stuff, and they get approved fine with no problems. US consular officials have also confirmed that this is allowed.

Yes, it is true. In fact, she stayed with her brother and sister-in-law (GC holders) and they paid for her costs and took care of her and the baby when they got out of the hospital. So she didn't lie, she was visiting.
