    Hi,

    My mother-in-law first visited USA on July 31st 2011 and stayed until October 19th 2011. Duration of stay: 3 months.
    Her 2nd visit was from January 1st 2016 till June 18th 2016. Duration of stay: 5 1/2 months.
    She again came to USA on September 22nd 2016 and her I-94 expiry date is March 21st, 2017.
    We would like her to stay for few more months this summer.
    (1) Is it advisable to file her extension for stay in US? If so, can we request for another 6 months?
    (2) Is there a chance USCIS may deny the extension and she might have to travel immediately, even before her current I-94 expiry date? Do we have grace period if her extension is denied?
    (3) If the extension is denied and she returns to India, can she travel back to USA after 6 months?
    (4) She has 10 years valid VISA. Is there a chance that if we apply for stay extension now, her VISA status may be revoked?
    (5) It was mentioned that we need to file atleast 45 days in advance for extension. But we have only 40 days. Can we file now?
    (6) What supporting documents are required when we file for extension?

    Please help and advise.

    1. It's not advisable. If you try to extend her I-94 for 6months more her stay in US as a visitor will be too much in 2yrs.

    There is no grace period.
    3. Yes she can. But visitor needs to spend more time in home country than US.
    4. Most likely not. But if she visit frequently sometime immigration officer at the port of entry deny her entry or give warning. If she overstay then her visa will be void.
    5. You can. But if you want to file extension do it ASAP.
