Visa denied to my Spouse ..is it because im a US Citizen?

  • Visa denied to my Spouse ..is it because im a US Citizen?

    Im a US citizen..( with dual citizenship ) my spouse is Nigerian. He's been trying to apply for a Non immigrant B1 visa and has been denied 3 times..( once while we were in Nigeria and even now that im in the US to have the baby with my hospice records, invite etc) they still denied without any encouraging hint as to why. Could they be denying him the Visa because im a Citizen? Thats what his family members are telling him and some front door staff at the embassy.. Is there any validity to that?

    The best way to get him here on time is to file for a Fiancé(e) Visa. Best of luck

      He may have a better chance to apply for an immigrant visa. My thinking is that they may suspect that he will apply for AOS anyway.

        You can't apply for fiancé visa (K1) if you are married.

        It's probably easier in the long run to apply for PR so you won't need to worry about visas. Plus spouse based cases are much easier to get approved.

          Yes, it is because you're a U.S. citizen, and you are in the U.S. He will not be approved for a visitor visa, not even for the birth of your child.

          I am not clear on if you are only here to deliver the baby and return to Nigeria or if your intent is to stay here and live and bring your spouse here as well.

          If your intent is to stay, then once you have established a permanent residence here, you can file for a marriage based green card for your spouse. This will take awhile... several months.
