  • Please Help ---VISITOR VISA

My girlfriend applied for a US student visa ( f-1, 3 time) two years back and was refused based on section 214B. ...Do you advise if she applies for a Tourist Visa given that she can establish her strong ties back home.......I am few months ( 9 months) away before I am eligible to apply for a US citizenship, but the whoel process ( filing and waiting) may take 1 1/2 to 2 yrs. ......Because of nature of my profesison and that I am a GC holder, I cann't leave US for long and it would be nice if she could be given a permission to come and visit US.

Any help you can provide is greatly appreciated.

Was she refused F-1 three times? What was the reason for denials?

Since she is single and young, it will be almost impossible to get a visitor visa
to meet her GC holder boyfriend as she will be suspect to marry him in US and not come back.

She could try for a tourist visa (touring US) without a mention of you
but in that case she will have to show that she has toured other countries
and she is genuinely interested in touring.

      Please Help ---VISITOR VISA

Thanks for the reply taco....Yes! All 3 requests were rejected due to section 214b.
She did not mentioned anything about me during her interviews, and she did not have any sponsorships from the states (US citizen). It was all of her own and her family sponsored for her tuitions and lodging....Her goal is to come to the States temprorily so that I don't have to keep taking too many leave of absence from work.

If I understood correctly, based on your reply she is eligible to apply for a Toursit visa even though she has already been denied 3 times (in F-1). Whether it gets approve or not, it's a different story.

      thanks again,
