    Hi Forum,

    I am emailing you today for some advice regarding an American holiday visa for my Personal Healthcare Assistant.

    I am going to Hawaii for Christmas and due to my severe disability I require 24/7 healthcare support.

    Unfortunately my Personal Healthcare Assistant has a criminal record, due to a small offence committed when he was younger.

    When applying for an American holiday visa online there is a section where you can choose what crime it falls under. However on the application there is not a definitive category that he falls under.

    I have tried to ask the American embassy for advice regarding which option would best fit my personal healthcare assistant but they have responded to me; to answer the question to the best of knowledge. This was not very helpful at all.

    I do not want to select the wrong option and therefore submit an incorrect visa.

    If you believe a consultation would be the best way forward I would be open to receive legitimate recommendations

    What was the crime, and what are your options on the DS-160/ESTA form?

      I am having trouble with question number 2 in the Eligibility Questions. I am not sure if I can say No as I have the following recording on my DBS :

      I am not sure if these are considered as "crimes that resulted in serious damage to property".

      I basically took my moms car without permission. I had no license. I was starting to reverse it out of the drive way and I bumped it into a Neighbours car.

      So my mother could claim off her insurance; I handed myself into the police and they went completely overboard trying to make an example out of me. But here is what is written on my criminal record.

      - Aggravated véhicule taking (TAKING)
      Accident cause damage to véhicule
      under 5000 GBP
      on 03 August 2009
      Theft act. 1968. S. 12A

      -Driving otherwise than in
      accordance with a licence
      on 03 August 2009
      Road Traffic Act 1988 S.87 (1)

      - Using Vehicle while uninsured
      on 03 August 2009
      Road Traffic Act 1988 S.143 (2)

          That sounds like a crime resulting in serious damage to property

          It's his only crime involving moral turpitude, so he will probably get his visa without any issue
