  • Vistor Visa Extn

    Case:
My mother (Age 65), widow, is in B2 multiple entry visa for 10 years. She reached first time in USA in June 2017 & currently in USA. As per her I94, she need to leave

USA by Dec 2017. She is fully dependant on me as I am the only child to her. With this, could you please clarify my below queries ?

    i) If she apply for her B2 visa extn for another 6 months from Dec 2017 & if she leave USA by June 2018 only,
    a) can she be back again to USA in 6 months by Dec 2018 ? b) Will there be any problem in USA Port of Entry ?
    c) will they admit her second time with reduced I94 less than 6 months ?

    ii)
    a) If she leaves USA by June 2018, and if she reach back USA by Dec 2018 second time in 6 months, will she be admitted ?
    b) If she is admitted second time, can she apply extn for another 6 months in USA ?

I fear that they may reduce the visa to one year multiple entry or void the visa if she follow the above approach. Please provide your answers point by point.

She "can" try to come back to the US at any time, even the day after she leaves if she wants to try. Whether she will be admitted and how long she will be admitted each time is up to the officer at entry. Of course, she may have a harder time entering if she comes back too soon. But there are no hard and fast rules. It's possible for her to come back the day after leaving and get admitted for 6 months again. It's possible for her to be admitted for shorter or be denied entry. But even if she stays away for years, it's still possible for her to be denied entry or admitted for a short time.

    Nobody can predict that.

They might. They might not. It's up to the officer at entry.

Again, she might; she might not. It's impossible to predict.

Any time she's in the US and in status, she can apply for an extension. Even the first time, after getting the first extension, she can try to apply for a second one, and if she gets that, she can try to apply for a third one, and so on. There is no technical limit. Of course, the chance of getting each additional extension is lower.
