  • Revisit: Duration of stamp

    Hi,
My Parents visited US last year on tourist visa sponsored by my brother in Cali. They stayed less than 6 months and went back just before 6 months.
Now my wify is pregnant and I want to bring my parents here in NYC.
What are the possibility of them getting 6 months stamp? If I don’t get 6 months and say 3 months, Is it safe to ask for extension for another 3 months? Does extention get approved normally? Are there any future implications if we apply for extension?

    Thanks in Advance

    Hi-

It is always better and advisable to stay only for the given visa period. You can always extend the visa period but it might affect your future come back to USA as the CO might ask questions like "What is the reason for you to extend your visa last time your visited USA?" and also questions related to it.

My suggestion is to stay for the duration of the visa period and go back and come back again. Don't take any chances.

The same thing happened with my friend's parents, 1st time they were granted 6 months visa but they over-stayed and 2nd time when they went for the visa, it was rejected based on this reason.

Hope this helps you to think.

      Thanks Sat for explanation.
I'm bit confused over here. My parents already have visa for 10 years. So if we ask for extention and suppose got approved , next time they still need to apply Visa?

What is the possibility of getting 6 months stay in US?

If their extension is denied then the visa will be void then they have to re-apply. If approved they are good to go.

Generally they will get 3-6 months

I am assuming your parents still have the valid 10 yrs visa! If you are talking about 6 months validity of I-94 mostly if your parents came here and went back before the visa expired POE officer shouldnt have a problem. I know a friend whose parents were first given 3 months visa - they requested that it wasnt enough since they wanted to tour and visit family within that time and the POE officer immidiately gave them a 6 months...
Many a times us indian fight with the POE officer and spoil the whole thing... but if you request them humbly they should be ok...

I think extension of another 3 months or 6 months is usually granted - i know some friends whose parents asked for 1 year 1-94 and were granted that at Houston airport. And I know most of our friends parents were able to extend their stay very easily... the good thing on your side is your parents were here and went back before the designated time.
          Hope this helps...
