    Hello,

    I just got engaged this weekend to my Brazilian gf of 3 years (I am a US citizen). She has been here on a B1/B2 visa her entire time in the US. We travel a lot so its never been an issue as she has always received 6 months.

    My hopeful idea was as follows:

    -vacation outside of US for Thanksgiving
    -civil wedding end of December
    -vacation (mini-honeymoon) for New Years to Asia
    -start green card application upon returning and she would have no travel planned

    I am being told that the travel complicates things, as customs can view the last entrance as fraudulent (coming to file papers, not as a tourist) and that likely we would need to file in the US Embassy in Brazil and she would need to have an interview there.

    I know you can simply say to cancel the trip, but it is paid for and sort of a dream trip for the both of us.

    Appreciate in advance for any help as we are getting a little stressed by the process.

    You are right that it is inappropriate to seek admission to the United States on a B visa with the expectation that you will apply for adjustment of status

    Your girlfriend can avoid that situation by either getting married and applying for adjustment of status now, or by applying for an immigrant visa from outside the United States
