My parents were given 1 month Visa,want to extend there stay for 4 -5 months

  • My parents were given 1 month Visa,want to extend there stay for 4 -5 months

    Hi my parents arrived in United states on 23rd Jan 2018, they were told that they can stay only for one month by visa officer at airport, there last visit to USA was on 24 June 2017 and returned back on 17th August 2017.they stayed less than two months.They have returned back after 5 months, we had plans to visit many places in 5 months duration and now everything is at stake, they cannot cover all the places in one month as they are over 65 years and cannot travel continuously .Is there any way i can extend there visa. USCIS says you should apply for extension within 45 days of departing but my parents were given only 30 days.Any help would be really helpful.

    First of all, check their I-94 online. Sometimes the officer says one thing but the I-94 says another. It's the I-94 that's authoritative.

    They can apply for Extension of Status. All that is needed is the application is officially received by USCIS before their status expires. You don't have to do it "45 days" before; 0 days before is fine as long as it is received by then.

      Immigration officer told you can stay for 1 monh, but i94 says 6 months

      Hi my parents were told by immigration officer that you have been given one month visa and if you stay more than one month you cannot enter United States again, but i checked there i-94 online , it says 6 months, i am confused and concerned , i also checked on passport there is nothing mentioned there.If i go according to i94 and they stay for 6 months and if they return back after one year i don't want them to be deported and i hope there visa wont be void.

        Irrespective of what one says (or may be your parents misheard), the only valid proof is the issued I94. If the I94 in the system says 6 months, then that is what it is. You need not fear of any consequences as long as you stick to not exceeding the duration of stay mentioned in the I94.
