Mother Over Stayed Tourist Visa For 2 Weeks

Hi.

My mother is 80 years old. I am a US Citizen. She arrived the USA November 12, 2005Today is May 22, 2006. I just noticed her Visa expired last week. I wanted to file for adjustment of status, form 1 485. What do I do. She was sick and I was carried away focusing on her to get well.. Only to noticed that her visa expired last week Please help..

Not to worry...coz im overstaying for almost 1 week now. Im married to a US citizen and im applying for green card and lots of paper work to get ready. Best advice is make a appointment through infopass at usic.gov and meet up an officer and get all forms u need before sending out.

For now all you need
I-130
I-485
2 photos of her (immigration standard)
Filing fees
Proof of relationship (birth certificate)
copy of her passport an d her visa
Copy of I-94 card
Proof of your citizenship
Because she's over 79 she wont need form G-325 A ( I am not sure if u would need one but since there is no charge for this form filing one wont hurt your case and you too will need 2 photos for that)

You can send the foll. with the forms listed above or at a later date although its always good to send everyhting together so try if you can to do that. You need to go to USCIS website and see what civil surgeons do the immigration examninations

But go to the USCIS website and look under forms and you can download all them and see what the fees are. Try to do a different check for each form and make sure you complete them properly. Make sure the fees are correct becaus eif you're off by a penny they're going to return the docs to you !!!Make a copy of everything you send nad do NOT send originals unless requested because they are not going to be returned! Send your package by certified mail and you're good to go.
