B2 Visa Rejected - Bro in law & Nephew. Can I reapply immediately ?

    Hi,

    I am on H1B, sponsored B2 visa for my parents and they got the visa approved for 10 years.

    My nephew (7 years old) was also very interested in travelling as it is summer holidays in India. I sponsored for my brother in law and nephew (sister already has Business visa). They attended interview and visa was rejected with 214(b). The officer didn't ask for any additional documents, can we reapply again immediately and do a self sponsor instead of me sponsoring them ?

    I don't have much time to wait for as his school reopens in June and he has to return to India before that.

    Questions are as below:
    1) Where are you going to US
    2) How long are you planning to stay - 3 months (Hope this should have been 1 month).
    3) Are you going as family ? - Yes
    4) What is your purpose of visit - Tourism
    5) Are you working ? - Yes
    6) Does your wife has visa - Yes she has (Hope he should have mentioned that she holds business visa only)

    You can always try, but the outcome depends on the VO giving the Interview.

      If reapplying should I sponsor them again (like first time) or can my bro in law do a self sponsor ? Will a change in sponsorship have a negative impact ?

        The best is to have them self-sponsor their visit (it shows strong ties to home country - like properties, business etc).

        Your sponsorship is only suggested when they cannot show sufficient funds to sponsor themselves.
