Visiting USA-Canada-USA on b1/b2?

  • Visiting USA-Canada-USA on b1/b2?

    My parents have multiple entry visa for USA and Canada both. They are planning to visit us here in USA in May-2018. They will stay here for 1.5 to 2 months and will go to Canada to visit my sister. They will come back to USA again in few months. Here are my questions,
    1) lets say they land in USA on May 1st and they show air ticket of July 1st to Canada.
    a) will they be getting I94 for 2 months or 6 months ?
    2) If they get it for 6 months and their entry is valid till Nov 1st,
    a) in this case, if they go to Canada on July 1st and return to the states after Nov 1st , say Nov 15th. will it be considered as RE-ENTRY, if Yes then will they be getting I94 of 6 months (Nov 1st to Apr 1st)? They can show return ticket of Mar 1st to their origin country.
    b) What if they re-enter the states before Nov 1st? will they be getting new I94?

    A lot of people try to tweak around US system to let their parents visit other country for few days/weeks/months & re-new their I94 for another 6 months. By doing so parents shows that they no longer have strong ties to their home country - this can jeopardize their visa & can be denied entry.

    However sometime the officer at POE ignores this & they can get entry - we have seen multiple such cases.
    - I am not an Attorney, hence not giving any legal advice. Just sharing MY opinion with an intent to help others.

      Thanks for your response! We are not trying to extend their stay by visiting Canada. The purpose of their first visit to USA would be just to attend one social event. and their first stay will be for less than a month. However when they come again after spending time with their daughter in Canada, we want them to spend few months with us here in USA. in this case, will it jeopardize their visa ?

        Yes - chances are high.

        However if they can confidently prove (not easy) that their intention is not wrong & they have their confirmed return ticket to their home country - they will be allowed re-entry & won't have any issues during next visits also.

        The key is to be truthful & confident in front of VO.
