  • I need help..... please help me...

    Hi dear all members.

    As i have B1/B2 visitor visa for 5 years. last year in 2017 i went to USA for first time for visiting purpose, and i got 6 months entry permit ... i stayed in USA for around 5 and half months and came back to my country ... now iam in my home country and go back to USA again after around 9 to 10 months , but i am afraid and bit confusion.

    will they give me entry permit or not?

    what can they ask from me? because i stayed for 5 and half months but came back before invalid of my entry permit.

    can they ask me why iam coming again in usa soon???( means it has been 7 months after leaving usa)...

    please help me .... what should i tell them?

    should i go to usa or not ??

    will they not give me entry permit??

    please help.... iam waiting for your reply..

    You can visit US again.

    You stayed in US for around 165 days. That is less than 6 months. So you did not breach any immigration laws in your last visit.
    If your visa is multiple entry, I don't think they will deny you entry unless you have a good reason to visit. Like visit your family or your friends.

      You have to be aware that if you're granted a B1/B2 visa it's valid for up to 6 months entry but it does not mean you can automatically stay for 6 months. When you reach the customs and border patrol agents upon entering the country, they give you a stamp which tells you by when you must leave the country. If the stamp is the full 6 months then you're fine, but if they stamped you in for a shorter time, then you may not be, you should check your passport and/or your I-94 record.

      There is always a lot of confusion regarding the 6 month validity of the visa, some people don't realise the CBP officers can and sometimes do allow you entry for a shorter amount of time.

        yes my brother is in USA and last time i got 6 moths entry but i left USA before 6 months means around 5 and half months i was over there.

        Now i want to go with my father for visit to my brother. so can i go to usa after 8 or 9 months gap period.if they ask why you come soon for visit ? and why you did you stay in usa for 5 and half months last time ? what should i say??

        No i got entry for 6 months and i left usa with 5 and half months. it was valid. but iam confused that if i go to usa after 8 or 9 months gap period then they can ask from me why did you stay for longer period last time? and why you have come soon to usa again after first trip? then what should i say?

        now i want to go with my father .. last time i went alone.

        second point is i have still valid visa of usa ... if i apply for new passport for any reason ,will my visa valid for travel???

          I would advise you to wait a couple of years to visit again. An 8-9 months interval might raise suspicions on the Border Patrol's mind, like, what company/employer allows an employee to go on vacation for 6 months and then go on vacation again after less than a year, or, what is this tourist doing here again so soon? The Border Patrol is paid and trained to be suspicious. For them, you are already guilty of immigrant intent. The burden of proof that you have no immigrant intent, and just going for a visit, is up to you. Visiting twice in less than a year then using the maximum 6-month stay will be a red flag.

          I had my 10-year multiple entry tourist visa in 2009. I first entered the US in July 2009, was granted a 3-month stay, I stayed for 2 months. Three years after, I visited a 2nd time in 2012, was granted a 6-month stay, and stayed for 6 months. Five years after (2017), I returned for a 3rd visit and was granted 6 months stay. In between visits, I stayed in my home country, went to work, traveled domestically, saved up for the next US visit/s.

          Not all cases are the same, so it could be different with you. But bottom line is, don't give the CBP a reason to be suspicious.

          Yes, your US visa will still be valid even if you have a new passport. You just need to staple both the old (where the US visa is) and new passports together; don't keep them apart. My 3 old/new passports are all stapled together; the US visa is on my oldest passport. The CBP will know where to look for the US visa.

            Yes, your US visa will still be valid even if you have a new passport. You just need to staple both the old (where the US visa is) and new passports together; don't keep them apart.             Thats' why i am bit confused...

            But i want to share that i have also Canada visit visa. if i go to Canada via USA (like transit visa , want to stay for a few days in USA ). Then is it ok?
            second point , in this trip my father will be with me....So thats why .....
