  • B2 limited stay

    Hi,

I am in need of some advice, thank you for your time everyone. Here is my situation.

My brother (27 year old) came to US yesterday. He has a 10 year multiple visit visa and this is his first time visiting in 8 years of his visa. His POE was New York. He has a return ticket scheduled after six months.
During his immigration, he was asked for his ticket and asked why he was visiting. He said he is visiting his brother and is here for tourism. They asked him how his trip is funded and he said that I am taking care of it. Then the officer asked him to sit and wait. The officer called another officer and they talked to each other, they wrote something on the computer. After about half an hour when he was called he was given a limited stay for three months and they told him how can he stay that long without any work and that he needs to go back by then or he will be deported.

My question is - Is it advisable to apply for an extension of stay in this situation or are we going to make it worse by applying for an extension?

you can always apply for an extension but the end decision comes from the VO when you apply. Best of luck
