  • Getting married in US while on B2 visa

Hi would appreciate advice on the following:

I am a US citizen by birth and I am engaged to be married in January 2019. My fiance? is expected to be visiting US in August. Would it possible to marry in the US while she is visiting US on B2 visa and file for adjustment of status? I am afraid if I apply for K1 visa now, it will be not be approved before the wedding in January.

That will be mis-use of B2 visa & can create problem for her K1 visa.

If she comes to the US on a B2 visa with the intention of getting married and adjusting status, that's visa fraud. This is because when you request to be granted a visitor visa you're promising the government you will return to your country before it expires. So you're then lying to the US government, which can lead to bans to the country.

You might have read that some people do marry and adjust status while on a visitor visa, but the difference is usually when the marriage was not pre-planned, but something decided once in the country, therefore that's not visa fraud as you didn't intend to stay and adjust status.

Be very careful with this. Another option is for her to come over on B2 for the wedding, return to her country and then apply for spouse visa. Or as you say apply for fiance visa, which may or may not be granted before your planned wedding.

Since you have clear immigrant intent I'd suggest keeping clear of using a B2 for fraudulent purposes, coming to the US to marry and remain and adjust status. It's not worth the risk in my opinion.
