  • Dads Visa rejected 4 times, applying for the 5th time

    Hi,
I am a little lost here. Please help!!

My dads Visa was rejected 4 times in 2016, reason 214b. We were desperate to have him here as my daughter was undergoing chemo in stanford. Even letters from docs didnot help. He is retired state gov employee but consults for state SPACE application center. He has house ( on my moms name) and agricultural lands in India. my mom got her Visa 10 yrs ago , my dad dint go with her for Visa then. My grandparents are alive and he has a job to go back home to. I am their only child. BTW when he applied in 2016 we had L1 Visa , now we have a green card. will that be a problem

!) Should I sponsor his Visa like last 4times of should he sponsor himself?
    2) Will working for SPACE application center be a problem? should he resign ?
    3) I work as an independent consultant with multiple customers so I have pay checks but wont be able to get a letter from the employer? How should I project that?
    4) how can i show stronger ties to India , if they are not looking at property details or at the bank records?

Any suggestions at this point are truly helpful as we are preparing for another Visa appointment

Unfortunately having him sponsor himself won't make much of a difference, owning land and a house in someone else's name proves that the person who's name it is under has strong ties to their home country but does not prove that he has strong ties, as for the job, although it does help a bit, a job like that could be done from anywhere including remote working from another country which does not show strong ties or deflect the fact that he could be an immigration risk. if his wife has a visa, and she is able to regularly travel to the US and was able to apply to adjust status and was approved then that would allow her to file for him to adjust status, which is also the case if you are a permanent resident. You can always apply again for the 5th time but keep in mind the end result is up to the VO as to whether to not he will be approved this time. and if nothing has changed since the last time the odds of it ending in the same result are very high.

What about your mom? Does she have visa? Is she not planning to go with her husband?

My mom already has her Visa, she applied for hers a few years ago when dad was busy at work. She frequently travels to US without my dad. This time around we are hoping to have both of them here with us

What is adjust status? HOW can we apply for that.

Things that have changed . Will any of these make any difference one way or the other
          1) we now have green card
          2) I am now working , so I can sponsor him. My husband was the one who sponsored him last 4 times as I was not working then. I can send my bank information
          3) HE transferred ancestral property like lands and a home in his home town to his name. Though the house that they live in is in my moms name

adjustment of statuses means applying for a Green Card which you already have, which means your father is now an even higher immigration risk
