  • Travel to US on a B2 while I130 is pending

    Hi,

    I am a US citizen and have sponsored my mother's I130 application. She is planning to visit me next month. While she has previously visited me multiple times without any issue, this will be her first visit when her I130 application is pending

    1. Is she allowed to visit when when her I130 application is pending ?
    2. Will she encounter issues at immigration?

    Anyone who had a parent travel in a similar situation could you please let me know how it went?

    1. It's going to be very hard for her to come visit, while many have done so under a B2 visa, if she mentions that you have filed for her to become a permanent resident the customs officer will more than likely put her on the next plane home. I would recommend

        1. If she's traveling on a B2 there's no need to mention an I-130 pending if she's not asked. I wouldn't encourage her to lie about it. In fact NEVER lie about anything to them because chances are they know if they're asking.
        2. There is ALWAYS a chance she'll get pulled into secondary. Especially if she's from one of those country's the regime *ahem* I mean administration considers to not have our best interest.

        Feb 2017 - Date received
        Feb 2017 - RFE received
        March 2017 - Biometrics completed
        April 2017 - RFE response received case no longer on hold
        April 2017 - Case is being scheduled for interview
        May 2017 - AP/EAD received:
        March 2018 - AP/EAD forms sent for renewal
        Sept 2018 - AOS interview scheduled.
        Oct 2018 - AOS interview
        Nov 2018 - Green card in hand

            Can you please share what was the outcome. Was she allowed to enter or any difficulties or questions they ask. I have similar situation and looking for guidance.
