  • Visitor B2 Visa for parents after getting my Green Card

    Hello All,

    I have received my Green Card recently, and want to apply for B2 visa for my parents for 2nd time. They were rejected first time, while they applied during my green card adjustment of status(AoS) pending period. They also self sponsored that time, and now I want to sponsor for their visa with Form I-134.

    The VO usually asks for any change after re-apply. The major change since their denial is my green card approval. During their 1st attempt, I was in AoS and the VO looked at my documents such as passport, I-130, I-485 etc and said that they can not approve their visa. From this, we have a speculation that the VO didn't like the idea that my status is not confirmed here, why giving visa to my parents. Also, my son has born after their interview date, so we plan to tell this as one of the reason their visit to see the grandson.

    My question is:
    1. Have anybody gone through similar scenario? What is the likelihood of their getting visa?
    2. They have taken notarized documents to show their ties, but the VO didn't want to look at that. What is the most effective way to show the ties such as properties, since DS-160 has no such section?
    2. My parents can pay for their trip, and that is what they put in their first try. I was wondering, whether this time I should put myself?
    3. I used my email address to apply on their behalf. Do you suggest to use their own email address while applying to show that they have applied themselves?

    Any kind of suggestions will be greatly appreciated. Thanks in advance.

    Sometimes i wonder if people care to read some of the other posts in here before they make their own.
    Your question has been answered a million times on this forum.
    1) don't even think to supply any form i 134 or as such. Nobody is going to check it , it is unnecessary, and odds are that your parents visa is going to be rejected again because they have to show their own assets to get the tourist visa. Hinting or showing that you going to take care of everything is one of the number one reasons for tourist visa denials. TOURIST VISAS DON'T NEED SPONSORING BY ANYBODY ELSE BUT THE PEOPLE APPLYING FoR IT. By doing so you compromise their chances!
    2) Mentioning the new grandson is going to hurt their chances even more. Many times there is the assumption that parents will visit to help with the child. It is considered illegal work and its one of the main reasons many times tourist visas get rejected.
    3) Your now confirmed green card status is going to hurt their status even MORE! as now they are seen as definite potential immigrants with your blessings!

    You have already done enough damage by making their previous interview about you and your status. Please save them by not attempting to bombard their new application with information about you!

    Let them apply and showcase only their own merits and assets and home ties if you want them to have any chance at visiting you.

      Thanks for your reply. There are so many opinions around this, I was actually looking for some advice for similar scenario. In their first time, I did not send any sponsoring doc, they brought their own notarized asset documents. However, the VO hearing that I am in green card pending status, asked for my green card application materials, passports etc and said they are not pleased. Thus, we assumed they did not like that I am in pending status at that time. The problem is they don't even want to see any of those asset docs. Also, I can not find any place in DS-160 where we can say in details about their asset other than the occupation section in DS-160 only. Any tips on that please?

        No body knows, but they do have their own way to examine your profile - hence they really do not ask for any documents.

        They ask for documents only when, they do not have information from their system.

        Did you parent mentioned that your wife is expecting during their first interview? or their plan was to support you during those days?

          No, I have specifically instructed them not to bring up about her pregnancy during the interview. I have read in several forums that it may backfire. However, now my son is born, shouldn't they just mention that they are going to visit us including their grand child? Or, that may be a negative point? Thank you.

            In reality, pregnancy is not the only issue. Its after birth support as well. So if they say that they wanna visit their 2-3 months old grand child - they'll still be taking a job.

                Sorry for not meeting your expectation.

                But I've seen applicants saying they wanna see their newly born grandchildren & requested for couple month stay - got rejected & were approved later after couple of year.

                  Correlation does not imply causation. On the other hand you see thousands of B2s issued every year wherein parents are visiting the US for the first time for this very reason viz., imminent arrival of grand kids. Each case is handled on its own, and hence drawing generic conclusions either way (for or against) is fraught with fallacies. Just my 2 cents.

                      Update: My parents got visa on their 2nd attempt! Thanks to the almighty and all of you with your valuable opinions.

                      Few things I would like to mention here, if anybody is following this thread:
                      1. This time I have shown myself as the person paying for the journey. I have sent i-134 as well, though they did not ask for it.
                      2. It looks like my Green Card DO have something to do with it. Unlike lot of the posts say that they almost surely ask for 'the reason of reapplying' and 'if anything has changed for the applicant', no such questions were asked. They have wanted to know about me, how I went (F1 visa), what I am doing now etc. and asked for my immigration status documents. My parents have given them my green card copy, PP copy, job authentication letter and a pay-stub that I sent to them. No other document related to my parents were asked.
                      3. While nobody knows for sure how the system works, my suggestion for those who are reapplying would be to wait for several months before reapplying. Finally, even if nothing else changes for your relative, they can still get visa if something changes for you! So keep faith and give it a shot! Thank you.

                            Your current status is still non-immigrant & they have to say the same thing.

                            Are you getting your GC from your would-be ?

                              I am not discouraging, but from my experience and from others' I can say that the time during the AOS is little bit tricky. Especially when your relatives are trying to come to US on B2 visa, while your own status is pending. I would say though to send out any job related documents you have along with pay stub, bank docs etc. They may ask a lot about you such as how did you go to US, how did you apply for GC etc. Good luck!
