  • Can spouse of H1B will go for visiting visa?

    Hi,

    I am on H1B who recently changed my employer and applied for H1B transfer status is still pending have not received any approval . My H1B from previous company is until May2019.
    Since my h1b is not yet approved, can my spouse apply for visiting visa ? what are possible issues if you go for the interview? or can she go for h4 stamping with my previous h1B approval (H1B from previous employer)?

    Since you have left that company that H1B is not valid anymore.

    What is current status of your wife right now? Is she in USA or outside USA?

        Better she will wait & then apply for H4 directly.

        B2 visa has basic requirement that she will return back - but in your case, it's obvious that she will try to stay as long as possible. Or do a COS once she reach there.
